Winehaven Legacy appeal (First District No. A173264)
From the public First District Court of Appeal docket. This page is a status note, not legal advice. It does not state how the appeal should be decided.
What the case is
Winehaven Legacy LLC v. City of Richmond et al., First District Court of Appeal, Division Two, No. A173264.
Trial court: Contra Costa County Superior Court No. C2201081.
Current status (as of the November 2, 2026 docket entry)
On November 2, 2026, the Court of Appeal ordered simultaneous letter briefs of no more than 10 pages on whether the appeal should be dismissed for lack of a final, appealable judgment, including whether the City and the City Council count as separate parties for finality. The court’s scheduled actions list a due date of November 12, 2026.
The order states that factual statements must be supported by citation to the appellate record and that facts outside the record require a declaration under penalty of perjury.
The appeal was filed April 29, 2025 and was fully briefed March 26, 2026. Both sides requested oral argument in early April 2026. No argument date or disposition is listed on the docket.
The November 2 order raises appealability. It is not a ruling on the merits of the appeal, and it does not decide whether any prior City action stands or falls.
What the November 2 order recites about the trial court
The City filed a seven-cause cross-complaint against Winehaven Legacy on April 19, 2023; the order states that cross-complaint remains pending.
A stipulated stay was entered on May 7, 2025, after an unreported hearing following the notice of appeal.
The trial-court docket page lists a judgment dated March 7, 2025; the November 2 order describes the challenged order as dated March 3, 2025. This page does not resolve that discrepancy.
